The Department of Labor (DOL) has strict filing windows. You cannot file your Form ETA-9142B more than 90 days—and no fewer than 75 days—before your Date of Need.
However, because the H-2B program is subject to a congressionally mandated cap, the "True" Date of Need often revolves around the semi-annual "drop" dates:
If you are aiming for these dates, your filing window is essentially the first three days of January (for April) or the first three days of July (for October).
Calculating your Date of Need requires working backward from your arrival goals. Even if the DOL and USCIS approve your petition on time, your workers still need to visit a U.S. Consulate for their visa interview and arrange travel.
Expert Tip: We recommend setting your Date of Need 7 to 10 days earlier than your "absolute latest" start date. This provides a small buffer for flight delays or administrative hiccups at the consulate without violating the "three-fourths guarantee" (the rule requiring you to offer work for at least 75% of the hours in every 12-week period).
