Safe and Compliant: H-2A Transportation Rules You Can't Ignore

Securing a legal agricultural workforce is only half the battle; getting your team to the field safely and legally is just as critical. For Florida growers, the H-2A visa program carries strict transportation mandates that, if ignored, can lead to heavy fines, back-pay orders, and even debarment from the program.

Effective April 7, 2026, new federal updates have adjusted the financial responsibilities for employers, making it more important than ever to review your logistics.

The 50% Rule: Inbound and Outbound Travel

Under H-2A regulations, employers are responsible for the "reasonable costs" of bringing workers from their home country to the place of employment.

  • The Reimbursement Trigger: Once a worker completes 50% of their contract period, the employer must reimburse them for all inbound transportation and subsistence costs.
  • 2026 Subsistence Rates: As of April 7, 2026, the minimum daily subsistence rate is $16.78 without receipts, and up to $68.00 per day with valid documentation.
  • Return Travel: If the worker completes the contract or is terminated early through no fault of their own, the employer must provide or pay for return transportation to the worker's home country.

Daily Worksite Logistics

If your workers are in employer-provided housing, you are legally required to provide free transportation between that housing and the worksite.

  • Cost-Free Mandate: You cannot charge workers for daily transport, nor can you deduct travel time or gas costs from their wages.
  • SOC Code Accuracy: For compliance tracking, Florida farms should note that a traditional farmworker who drives a crew van for two hours and performs general fieldwork for the remaining six is still classified under the Traditional Farmworker SOC code, not as a specialized van driver.

Vehicle Safety and the 2026 CDL Update

All vehicles used to transport H-2A workers must meet applicable DOT and state safety standards. This includes functional seatbelts, appropriate seating, and regular maintenance logs.

Perhaps the most significant shift for 2026 involves the Federal Motor Carrier Safety Administration (FMCSA). A final rule effective March 16, 2026, strictly limits the issuance of non-domiciled Commercial Driver's Licenses (CDLs) specifically to H-2A, H-2B, and E-2 visa holders.

  • SAVE System Verification: Drivers must now be verified through the SAVE system, and their CDL expiration must match their Form I-94 "Admit Until Date".
  • Florida Enforcement: Under current Florida Senate guidance, the operation of a commercial vehicle by an unauthorized driver is considered an imminent safety hazard, potentially triggering civil penalties up to $50,000 for the motor carrier.
