How to Get Your H-2A Visa Notice of Acceptance

  • A Detailed Job Order (Form ETA-790A): This document must outline every duty, requirement, and benefit you are offering. If this form is incomplete or inconsistent, you will receive a Notice of Deficiency instead of an Acceptance.

2. The Filing Window (75 to 60 Days Out)

Timing is the most common reason applications are rejected before they are even read. You must file your H-2A application **strong>no less than 60 days and no more than 75 days before your "Date of Need" (the day you need the workers to start).

  • Notice of Acceptance (NOA): This is the goal. It means your application is complete and complies with H-2A regulations.

What Happens Once You Receive the NOA?

The NOA isn't just a "congratulations" letter; it is a directive. It will explicitly outline your next steps, which usually include:

  • Placement of Recruitment: The NOA will instruct you to begin active recruitment of U.S. workers through CareerSource Florida and other designated channels.
  • Contacting Former Employees: You must reach out to U.S. workers who were employed with you in the previous year.
  • The Recruitment Report: You are officially "on the clock" to start documenting every U.S. applicant who applies for the job.

Checklist for a Flawless Filing

  • Requirement: Housing Inspection / Critical Detail: Must be scheduled or completed by the time the NOA is issued.
  • Requirement: FEIN Verification / Critical Detail: Ensure your Federal Employer Identification Number is active and matches your filing.
  • Requirement: Surety Bond / Critical Detail: H-2A Labor Contractors (H-2ALCs) must have their bond ready for submission.
  • Requirement: Worker Count / Critical Detail: Ensure the number of workers requested matches the "Statement of Need."

4. Avoiding the "Common Pitfalls"

To get your NOA on the first try, avoid these frequent Florida-specific errors:

  • Vague Work Descriptions: "General farm work" is often too broad. Be specific about the crops (citrus, blueberries, sugar cane) and the tools used.
  • Housing Discrepancies: Ensure the address of the worker housing in the application matches the physical location where the state inspector will go.
