Dealing with Weather Delays and Crop Loss in H-2A

In Florida, agriculture is always at the mercy of the elements. From late-season freezes in the citrus groves to the unpredictable path of a Gulf Coast hurricane, Florida growers face unique challenges. When a natural disaster strikes, it doesn’t just affect your yield—it impacts your legal obligations to your H-2A workforce.

1. The "Act of God" Provision

The Department of Labor (DOL) recognizes that "acts of God" (hurricanes, floods, or freezes) can make it impossible to fulfill a work contract. If you suffer a catastrophic crop loss that makes it impossible to provide the work promised in your Job Order, you may be eligible to invoke the Contract Impossibility clause.

  • The Requirement: You must receive approval from the DOL Certifying Officer (CO) to terminate the contract due to impossibility.
  • The Benefit: Once approved, your obligation to provide work (the Three-Fourths Guarantee) ends on the date of termination.

2. Responsibilities to the Workers

Even if a hurricane wipes out your season, you still have "final mile" responsibilities to your H-2A employees. If the contract is terminated due to a weather-related disaster, the employer must:

  • Provide Return Transportation: You are still responsible for the cost of the workers' return transportation and subsistence to their home country.
  • Final Pay: You must pay the workers for all work performed up to the moment of the contract termination.
  • Efforts to Transfer: The DOL expects you to make a "good faith effort" to help transfer the workers to another H-2A employer if work is available elsewhere.

3. Managing "Down Time" and the Three-Fourths Guarantee

If the weather causes a delay rather than a total loss (e.g., a field is too flooded to harvest for two weeks), the Three-Fourths Guarantee remains in effect.

The Rule: You must offer the workers at least 75% of the total hours specified in the work contract.

If a flood prevents work for a few weeks, you may need to increase hours later in the season to meet that 75% threshold. If you fall short, you are legally required to pay the workers the amount they would have earned had they worked the full 75% of the hours.

Weather Delay Action Plan

Step: Document / Action Required: Take photos of crop damage and keep weather reports. / Why It Matters: Provides evidence for "Contract Impossibility."

Step: Notify / Action Required: Contact the DOL Certifying Officer immediately. / Why It Matters: Protects you from "Three-Fourths" penalties.

Step: Payroll / Action Required: Track "Hours Offered" vs. "Hours Worked" during the delay. / Why It Matters: Essential for audit defense.

Step: Housing / Action Required: Continue providing housing and water during the delay. / Why It Matters: Housing must be maintained as long as workers are in the U.S.

4. Adjusting the "Date of Need"

If a freeze happens before your workers arrive, you may need to delay their start date.

  • Minor Delays: If the delay is short, you must notify the workers (and any domestic applicants) of the new start date.
  • Significant Delays: If the delay is longer than ten days, you may need to file a formal amendment through the FLAG portal to adjust your period of employment.

5. Insurance and H-2A Costs

Many Florida growers carry crop insurance, but they often forget to factor in H-2A compliance costs. When calculating your "irreparable harm" or loss for insurance or disaster relief purposes, be sure to include the costs of return transportation and subsistence for your H-2A crew, as these are mandatory business expenses triggered by the weather event.
