Securing a reliable workforce through the H-2A visa program is a strategic move for many agricultural operations, but the requirement to provide free housing often stands as the most significant barrier to entry. With the costs of new construction rising, many Florida growers are looking toward the conversion of existing facilities—such as residential homes, motels, or former apartments—into H-2A approved housing

Converting an existing structure is often more cost-effective and faster than building from scratch, but it requires a meticulous approach to meet the strict safety and health standards set by the Department of Labor (DOL) and the Occupational Safety and Health Administration (OSHA).

Understanding the Regulatory Framework

Before beginning a conversion, it is essential to identify which set of standards your facility must meet. Generally, housing must comply with either the OSHA standards (29 CFR 1910.142) or the ETA standards (20 CFR 654.400), whichever is more protective of the workers' health and safety. In Florida, the Department of Health (DOH) plays a primary role in these inspections, ensuring that migrant labor camps and residential housing meet minimum state-specific guidelines.

Key Requirements for Facility Conversion

Converting a building into compliant housing involves more than a simple coat of paint. You must address specific mechanical and structural ratios to pass your pre-occupancy inspection.

Space and Sleeping Accommodations

  • Square Footage: Each room used for sleeping must provide at least 50 square feet per occupant.
  • Multipurpose Rooms: If a room is used for cooking, living, and sleeping, the requirement increases to 100 square feet per person.
  • Ceiling Height: At least half of the floor area must have a ceiling height of at least 7 feet.
  • Bedding: Beds or bunks must be elevated at least 12 inches off the floor and spaced at least 36 inches apart. Triple-deck bunks are strictly prohibited.

Sanitation and Hygiene Facilities

Proper hygiene ratios are a frequent point of failure during inspections. When converting an older home or motel, you may need to add plumbing fixtures to meet these requirements:

  • Toilets: Provide one toilet for every 15 persons of each sex.
  • Showers: Provide one shower head for every 10 persons, with an adequate supply of hot and cold running water.
  • Handwashing Sinks: One sink is required for every six persons in shared facilities.
  • Laundry: You must provide one laundry tray or tub for every 30 persons.

Kitchen and Dining Areas

If you are not providing three prepared meals a day, you must provide free and convenient cooking facilities.

  • Stove Ratios: At least one stove per 10 persons or one stove per two families must be available.
  • Refrigeration: Refrigerators must be capable of maintaining a temperature at or below 41°F.
  • Surfaces: Walls and floors around cooking areas must be made of nonabsorbent, easily cleaned, and fire-resistant materials.

Florida-Specific Compliance and Inspections

In Florida, compliance is an ongoing obligation. Once a permit is issued, facilities are typically inspected at least twice quarterly during periods of occupancy to ensure standards are maintained. Key areas of focus for Florida inspectors include insect and rodent control, garbage disposal, and water supply safety, which must be capable of delivering 35 gallons per person per day.

The 2026 Housing Adjustment

Under updated 2026 regulations, H-2A employers may be eligible to apply a state-specific housing adjustment to worker wages. This adjustment allows for a slight reduction in the cash wage to offset housing costs, provided the final wage never falls below the applicable state or federal minimum wage. However, this adjustment applies only to H-2A workers and cannot be applied to U.S. workers in corresponding employment.

The H-2A application process is time-sensitive. Housing must be inspected and approved at least 30 days before the workers’ scheduled arrival. Any delay in housing approval can halt your entire application, as the DOL will not certify the labor need without verified housing.
